New Law on Tourist Rentals and the Role of Homeowners' Associations

Nouvelle Loi sur la Location Touristique et les Copropriétés À partir du 3 avril 2025, les copropriétés pourront décider si elles autorisent ou non la location touristique dans leurs immeubles. L’approbation de 3/5 des copropriétaires sera nécessaire.

🗓️ Starting April 3, 2025, homeowners’ associations will have the power to approve or deny tourist rental activity. 
Approval by 3/5 of the owners is required

🔑 Key Changes:

Mandatory Community Approval:
To rent an apartment for tourist purposes, you’ll need approval from 3/5 of the property owners, also representing that same percentage in ownership shares.

🛑 Right to Object and Take Legal Action:
If tourist activity starts without permission, the community president may demand immediate cessation and even initiate legal action.

💸 Extra Fees for Tourist Apartments:
The community can impose a 20% surcharge on shared expenses for units used as tourist rentals.

⚠️ Important Notes:

🕒 Activities that began before April 3rd are not subject to this new requirement (acquired rights are respected).

💥 Fines: Non-compliance may result in fines up to €600,000, depending on the region.
